This cause came to be heard upon the Motion of plaintiff and the Court finding, that service of process upon defendant, JESUS VALDEZ, be had by publication in the local newspaper of general publication in Lawrence County, Tennessee, as per State Law, with all other matters being reserved pending further orders of this Court.
IT IS THEREFORE ORDERED that publication of this Order be made for four (4) consecutive weeks in the Lawrence County advocate, a Lawrence County newspaper, notifying the defendant, JESUS VALDEZ, that he is required to answer and make defense to the Complaint in the office of the Clerk and Master for Lawrence County, Tennessee, within thirty (30) days after the fourth (4th) weekly publication of this Order and that upon his failure to do so, the Final Judgment will be taken as admitted by him and the case set for hearing without his presence.

TRUSTEE'S NOTICE OF SALE
   WHEREAS, JAMES D. CAMP and MARY CAMP executed, acknowledged and delivered to Kenneth Clark Hood, Trustee, a certain Deed of Trust dated the 15th day of September, 2008, and of record in Deed Book 302, Page 810 in the Register's Office for Lawrence County, Tennessee, to secure a certain indebtedness owing to GreenBank, now known as Capital Bank, N.A., and more fully described therein; and 
   WHEREAS, P. Edward Pratt was appointed Substitute Trustee by appointment dated July 17, 2013 of record in Book 414, page 256, but Capital Bank, N.A. is reappointing Kenneth Clark Hood to serve as Trustee instead of the said P. Edward Pratt; and  
   WHEREAS, default has been made in the payment of said indebtedness and the same has become due and payable after proper notice of default was given and the owner and holder of said indebtedness has declared the entire balance owing thereon due and payable, has given notice of acceleration, and has instructed the said Trustee to foreclose said Trust Deed and to advertise and sell the property therein and herein described, upon the terms and conditions set forth in said Trust Deed; 
   NOW, THEREFORE, notice is hereby given that I will on the 29th day of June, 2015, at 10:30 a.m. prevailing standard time in Lawrence County, Tennessee, at the main entrance of the Lawrence County Courthouse, 240 West Gaines Street, Lawrenceburg, Tennessee, sell the following described real estate at public auction, for cash, to the highest bidder, and in bar of the equity of redemption, the statutory right of redemption, dower and homestead, but subject to all liens, encumbrances, easements, rights-of-way, set-back lines, restrictions, covenants,  current and delinquent property taxes (ad valorem taxes), environmental claims, and the rights of any purchaser at a property tax sale or rights of redemption arising from a tax sale, affecting the subject property which are not extinguished by the foreclosure of the subject deed of trust.  The property to be sold is described as follows:

   This being the same property conveyed to James. C. Camp and wife, Mary E. Camp by Warranty Deed dated November 12, 1993, from Donald Joe Johnson and wife, Sylvia J. Johnson of record in Deed Book 271, page 345, Register’s Office for Lawrence Co., Tennessee. 
   Located on the Subject Property and to be sold with the Subject Property is a 1972 Monte Bello 65 x 12 Mobile Home, VIN 652FR2BRD7722140. Said mobile home is being sold AS IS, WHERE IS, WITHOUT WARRANTIES, EXPRESS OR IMPLIED. THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND HABITABILITY ARE HEREBY DISCLAIMED. There is no warranty relating to title, possession, quiet enjoyment, or the like in this disposition.  The debtor is entitled to an accounting of the unpaid indebtedness upon request without additional charge.  You may request such an accounting by writing to Kenneth Clark Hood, Laughlin, Nunnally, Hood, & Crum, PC, 100 South Main Street, Greeneville, Tennessee, 37743.  Name of Debtor: James D.    It will be the responsibility of the successful bidder to obtain possession of the property at his expense.  The successful bidder shall be responsible for any damage, vandalism, theft, destruction, etc., to the property.  This sale may be subject to valid filed or unfiled mechanic’s and materialmen’s liens.  No representations are made as to the validity or enforceability of any memorandum of mechanic’s liens or any suit to enforce the same.
   Interests in the property other than the Deed of Trust being foreclosed or matters affecting title known to the undersigned include the following:
   1.Affidavit of Affixation (Manufactured Home) recorded in Book 302, Page 6.
   2.Open-Ended Mortgage for purposes of TCA 47-28-183 (THDA Keep My TN Home Program – Foreclosure Prevention), Deed of Trust from Mary E. Camp to Bruce Balcom, Esq., Trustee, dated October 3, 2013, and recorded in Book 422, Page 262, securing Tennessee Housing Development Agency. 
   3.City and county property taxes for the year 2015 are not yet due and payable but constitute a lien on the premises.  County property taxes have been paid through the year 2014. City property taxes have been paid through the year 2013.  City property taxes are delinquent for the year 2014 in the amount of $6.18, but interest and penalties continue to accrue on this amount.  The exact amount owing can be obtained from the local taxing authorities.  
   4.All property is subject to zoning ordinances which control the uses which may be made of the property.  The undersigned makes no representation as to the uses which can be made of the premises in compliance with the applicable zoning ordinances.  
   5.This property may be subject to fees, dues and assessments of a Homeowners’ Association.  The actual existence of an association and the imposition of fees, dues and assessments are not typically of record in the Register of Deeds Office and you should ascertain whether a Homeowners’ Association has actually been formed and whether there are any unpaid fees, dues or assessments.  
   6.Rights of parties in possession, if any.
   7.Judgment against James E. Camp in favor of LVNV Funding, LLC, as successor in interest to Springleaf Financial Services, Inc., recorded May 4, 2015, in Book 454, page 19, in the original amount of $1,608.90, plus interest and cost.  James E. Camp is believed to be a different person than James D. Camp, who is reported to have died on May 2, 2011 according to Exhibit A to the deed of trust of record in Book 422, page 272 which recites: “James D. Camp a/k/a James Douglas Camp, Sr., died May 2, 2011, leaving Mary E. Camp as the sole surviving tenant.”  The undersigned makes no certification as to this matter.
   The sale will be made as Trustee only, without covenants of seizen or warranties of title, and subject to all liens, encumbrances, easements, rights-of-way, set-back lines, restrictions, covenants, current and delinquent property taxes (ad valorem taxes), environmental claims, and the rights of any purchaser at a property tax sale and/or rights of redemption arising from a property tax sale affecting the subject property which are not extinguished by the foreclosure of the subject deed of trust.
   The proceeds derived from the sale of said property will be applied to the payment first to the expenses of this sale, including attorney's fees, then to the payment in full of the indebtedness including interest secured by said Trust Deed, and the balance, if any, to be paid to the parties legally entitled thereto.  
   This sale may be postponed or adjourned from time to time without readvertising the sale, and the sale may be dismissed and not conducted.  The acting Trustee or any Substitute Trustee is authorized to appoint an agent or an auctioneer to conduct the sale, and any sale so made shall have the same validity as if made by the original Trustee.  The sale shall be for cash, to the highest bidder.
