TRUSTEE’S NOTICE OF FORECLOSURE
Default having been made in the terms, conditions, and payments provided for in that certain Deed of Trust dated October 3, 2016 of record in Book 492, page 395-403, Register’s Office for Lawrence County, Tennessee, from JONATHAN R. COGGINS and WIFE, HEIDI R. COGGINS, to PAUL B. PLANT, Trustee, securing the indebtedness therein described, which indebtedness is now due and unpaid, and has been declared in default by the lawful owner and holder thereof: and;
NOW, THEREFORE, I, Paul B. Plant, Trustee, pursuant to said Deed of Trust, having been requested by OLIVER M. BURCH, IV, the owner and holder of said indebtedness so to do, and by virtue of the authority and power vested in me by said Deed of Trust will, on Tuesday August 27″, 2019 at 10:00 a.m. at the Southeast corner of the Lawrence County Courthouse, in Lawrenceburg, Lawrence County, Tennessee, sell at public outcry to the highest bidder for cash (or credit upon the indebtedness secured if the lawful owner and holder thereof is the successful purchaser), free from the equity of redemption, the statutory right of redemption, homestead, dower, elective share, and all other exemptions of Borrower of every kind, all of which have been expressly waived by Borrower, the following-described property in Lawrence County, Tennessee:

BEING Farm #20 of RASCALTOWN FARMS, as shown of record in Plat Cabinet B, Slide 86, Register ’s Office for Lawrence County, Tennessee, to which reference is made for a more complete and accurate description of said farm. Farm #20 contains 3.32 acres, more or less.
This being the same property conveyed to Oliver M. Burch, IV by Quit Claim deed dated October 28, 2014 from GHM Partnership, of record in Record Book 444, Page 858, Register’s Office of Lawrence County, Tennessee.
This being the same property conveyed to Jonathan R. Coggins and wife, Heidi R. Coggins by Warranty Deed dated September 28, 2016 from Oliver M. Burch, IV of record in Record Book 492, Page 393, Register’s Office of Lawrence County, Tennessee.
Which has an address of: Stateline Rd., Loretto, Tennessee 38469, Lawrence County, TN.
Description reference: The description is the same as that used in Book 492, page 395-403, Lawrenceburg, TN.
This sale is subject to liens, easements, encumbrances, property taxes, rights of redemption of taxing entities and other matters which are prior in right to the lien of the aforesaid Deed of Trust. The Trustee may adjourn or postpone the aforementioned sale of real property by public announcement at such time and place of sale, and from time to time thereafter may postpone such sale by public announcement at the time and place fixed by the preceding postponement or subsequently noticed sale, and without further notice make such sale at the time fixed by the last postponement, or may, in its discretion, give a new notice of sale. The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Trustee, be cause for rejection of the bid, and if the bid is rejected, the Trustee shall have the option of making the sale to the next highest bidder who is ready, willing, and able to comply with the terms hereof. The proceeds derived from the sale of the property will be applied as provided for in said Deed of Trust and/or modification thereof.
All rights and equity of redemption, homestead, dower and all other exemptions are expressly waived by the Debtor in said Deed of Trust and title is believed to be good, but I will sell and convey only as Trustee. Title is to be conveyed subject to all prior liens, easements, covenants, conditions, encumbrances, and restrictions that may exist including, without limitation, any unpaid ad valorem taxes or other taxes, and also subject to any right to redemption that may otherwise exist.

WHEREAS, by Deed of Trust dated the 16th day of April, 2014, of record in Book 431, Page 719, in the Register’s Office for Lawrence County, TN, LEWIS C. HENSON JR. and Wife, AMY R. HENSON (the “Grantors”) conveyed to Kenneth Clark Hood, Trustee, the hereinafter described real estate to secure the payment of Grantors’ Promissory Note owing to CAPITAL BANK, a division of First Tennessee Bank National Association, a national banking association, successor by merger to Capital Bank Corporation, a North Carolina banking corporation, successor by conversion to Capital Bank, N.A., a national banking association (the “Beneficiary”); and

The Real Property and improvements thereon, if any, will be sold AS IS WHERE IS without warranties or representations of any kind. The aforesaid sale may be postponed to a later date by oral announcement at the time and place of the published sale or cancelled without further written notice or publication.
I reserve the right to take or accept the next highest or best bid at such sale should the last and highest bidder fail or refuse to comply with the terms of sale for any reason. In such event, I shall also reserve the right to reopen the bidding or republish and sell said Real Property at my option. The Beneficiary may become the purchaser at the sale.
The Successor Trustee reserves the right to conduct the sale by or through his agents or attorneys acting in his place or stead, including the use of an auctioneer.
