Notice is Hereby given that on the 17th day of September, 2019, Letters of Testamentary, in respect of the Estate of JAMES LENON WILSON who died August 10, 2019, were issued to the undersigned by the Probate Court Clerk of Lawrence County, Tennessee.
All persons, resident and non-resident, having claims, matured or unmatured against the Estate are required to file the same with the Clerk of the above named Court on or before the earlier of the dates prescribed in (1) or (2) otherwise their claims will be forever barred:
(1) (A) Four (4) months from the date of the first publication (or posting, as the case may be) of this notice if the creditor received an actual copy of this notice to creditors at least sixty (60) days before the date that is four (4) months from the date of the first publication (or posting); or
(B) Sixty (60) days from the date the creditor received an actual copy of the notice to creditors if the creditor received the copy of the notice less than sixty (60) days prior to the date that is four (4) months from the date of first publication (or posting) as described in (1) (A); or
(2) Twelve (12) months from the decedent’s date of death.

WHEREAS, on the 10th day of October, 2016, Curtis Kelly executed a promissory note to the order of Lawrenceburg Federal Bank payable according to its terms, which said note provided that at the option of the holder thereof, in the event said note was not paid when due, the whole of the same, the entire balance, could be declared due and payable; and
WHEREAS, the said note is in default and the holder thereof has instructed me, W. Charles Doerflinger, Trustee, to foreclose same and collect said note;
NOW, THEREFORE, by virtue of the authority vested in me as Trustee as contained in Deed of Trust from Curtis Kelly which said Trust Deed is recorded in Record Book 491, page 558-565, Register’s Office of Lawrence County, Tennessee, notice is hereby given that the property described below will be sold by me at the East Door of the Courthouse in Lawrence County, Tennessee, at public auction, to the highest and best bidder for cash, subject to all unpaid taxes, on:

The proceeds of the said sale will be applied first to the cost of the sale, including attorney’s fees and cost of publication notice; second, to pay the first mortgage to Lawrenceburg Federal Bank as set out above; third, if any remains, to the maker of the note as provided for in said note and deed of trust.
The said property is described as follows:
Situated, lying and being in the 8th Civil District of Lawrence County, Tennessee, adjacent to and west of Belew Drive, South of Belew Haven Subdivision, and described as follows:
Beginning at a steel post found in the west margin of Belew Drive, the Southeast corner of Belew Haven Subdivision; thence with the west margin of Belew Drive, South 5 degrees, 35 minutes, 00 seconds West 281.70 feet to an iron pin placed in Mamie Swindle’s north boundary line: thence with Swindle’s north boundary line; North 87 degrees, 30 minutes, 43 seconds West 339.00 feet to an iron pin placed, the east boundary line of Virginia Baxter; thence with Baxter’s east boundary line, North 2 degrees, 17 minutes, 55 seconds West 282.27 feet to an iron pin placed in the center of a proposed 50 foot road, the south boundary line of Belew Subdivision; thence with the center of said proposed road, South 87 degrees, 30 minutes, 43 seconds East 377.76 feet to the point of beginning.
This being the same property conveyed to Curtis W. Kelly from Preston Ridge Partners, LLC by deed dated June 29, 2016 of record in Record Book 484, Page 773, Register’s Office of Lawrence County, Tennessee.
The sale of the above-described property shall be subject to all matters shown on any recorded plat; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey of the premises might disclose.

All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Trustee.
