NOTICE TO CREDITORS
(As Required by Chapter No. 886, Public Acts of Tennessee 2012, TCA §30-2-306(b) )
CASE NO.: P20-2305
IN THE MATTER OF THE ESTATE OF:
RICKY MURKS, Deceased resident of Lawrence County, Tennessee.
Notice is Hereby given that on the 23rd day of December, 2020, Letters of Testamentary, in respect of the Estate of RICKY MURKS, who died October 16, 2020, were issued to the undersigned by the Probate Court Clerk of Lawrence County, Tennessee.
All persons, resident and non-resident, having claims, matured or unmatured against the Estate are required to file the same with the Clerk of the above named Court on or before the earlier of the dates prescribed in (1) or (2) otherwise their claims will be forever barred:
(1) (A) Four (4) months from the date of the first publication (or posting, as the case may be) of this notice if the creditor received an actual copy of this notice to creditors at least sixty (60) days before the date that is four (4) months from the date of the first publication (or posting); or
(B) Sixty (60) days from the date the creditor received an actual copy of the notice to creditors if the creditor received the copy of the notice less than sixty (60) days prior to the date that is four (4) months from the date of first publication (or posting) as described in (1) (A); or
(2) Twelve (12) months from the decedent’s date of death.

Default having been made in the terms, conditions and payments provided in a certain Deed of Trust, dated March 19, 2007, executed by Terry S. Tenison and wife, Cathy M. Tenison to Paul B. Plaint, Trustee, of record in Record Book 255, Page 815, in the Register’s Office for Lawrence County, Tennessee, and a Modification Agreement and Extension of Deed of Trust, dated October 2, 2007, executed by Terry S. Tenison and wife, Cathy M. Tenison to the Wayne County Bank, of record in Record Book 274, Page 338, in the Register’s Office of Lawrence County, Tennessee, and a Modification Agreement and Extension of Deed of Trust, dated May 10, 2011, executed by Terry S. Tenison and wife, Cathy M. Tenison to the Wayne County Bank, of record in Record Book 363, Page 800, in the Register’s Office of Lawrence County, Tennessee, and a Modification Agreement and Extension of Deed of Trust, dated October 16, 2017, executed by Terry S. This conveyance is subject to an access easement by and between Wal-Mart Real Estate Business Trust and Ben Purnell, Jerry Jaco and Harold G. Orton by instrument dated November 18, 1999 of record in Record Book 9, Page 997, Register’s Office of Lawrence County, Tennessee.
Subject to ROW to the State of Tennessee in Deed Book 209, Page 7, Register’s Office of Lawrence County, Tennessee.
Subject to a ROW easement being 30 ft. wide in Deed Book 277, Page 129, Register’s Office of Lawrence County, Tennessee, unascertainable to the location.
Subject to easement agreement in Deed Book 289, Page 660, Register’s Office of Lawrence County, Tennessee.
Subject to conditions and restrictions as setout in Record Book 9, Page 994, Register’s Office of Lawrence County, Tennessee.
Subject to building setback lines, easement, etc. on plat of which is recorded in Plat A, Slide 100, Register’s Office of Lawrence County, Tennessee.
This being the real property conveyed to A & A Investments, by deed of Terry S. Tenison and wife, Cathy M. Tenison, dated January 24, 2013, of record in Record Book 402, Page 243, Register’s Office of Lawrence County, Tennessee. Furthermore, this being the real property conveyed to Terry S. Tenison and wife, Cathy M. Tenison, by deed of Ben Purcell, Jerry W. Jaco, and Harold G. Orton, dated August 18, 2006, of record in Record Book 236, Page 320, Register’s Office of Lawrence County, Tennessee.
The sale of said property shall be subject to any and all unpaid taxes and assessments, together with interest and penalty, if any, and any and all other prior easements, restrictions, encumbrances, or liens of any nature.
