Division of Remediation
Notice of an Approved Administrative Settlement Pursuant to 42 U.S.C. § 9613(f) with Respect to the Former Mapco Express / Delta 1015 property
The Division of Remediation (“DoR”) has accepted into its Brownfield Program an approximate 1.48 acre parcel of property previously known as the Former Mapco Express/Delta 1015 Site to facilitate redevelopment of the Site by Montgomery G. Turner, Sr. (the “Voluntary Party”). The Brownfield Voluntary Agreement between the Voluntary Party and DoR includes liability protection for the Voluntary Party, including protection against third-party contribution claims regarding matters addressed in the Brownfield Voluntary Agreement. This notice serves the dual purpose of notice of the terms of the Brownfield Voluntary Agreement to the general public and to third parties that hold contribution claims under 42 U.S.C. § 9601 et seq.
The Site is an approximately 1.48 acre tract of land located at 1001 North Locust Avenue, Lawrenceburg, Tennessee 38464. Reports indicate that a gasoline station operated on the property from circa 1980 to about 2009. The facility historically utilized three underground storage tanks (“USTs”); one 15,000-gallon gasoline UST, one 10,000-gallon gasoline UST, and one 10,000-gallon diesel UST. The tanks were reportedly installed in April 1980. According to TDEC records, the USTs and associated piping were removed from the ground in March 2009 and properly disposed of at a landfill. The facility was granted a closure letter dated June 16, 2009. The DoR acknowledges that the Site has been impacted by past activities from previous owners and operators with volatile organic compounds. Remedial Action with regard to the Site is being overseen by the Tennessee Division of Remediation. All reports of the investigation and remediation of the site are on file with the Tennessee Division of Remediation.
The Voluntary Party intends to prepare the Site for commercial redevelopment at this time. The Voluntary Agreement between DoR and the Voluntary Party requires that certain land use restrictions be imposed at the site, which includes soil disturbance and groundwater usage. The subject site and surrounding area are serviced by municipal water, therefore, site redevelopment will not need onsite groundwater usage.
The public may contact Cameron Swanson in Nashville at the Department of Environment and Conservation, Division of Remediation, 711 R.S. Gass Blvd. Nashville, TN 37243 or by phone at (615) 687-7069 to obtain a copy of the Brownfield Voluntary Agreement or for more information. DoR is accepting written comments from the general public on the Brownfield Voluntary Agreement for thirty (30) days after the date of publication of this notice, and these comments should be mailed or emailed to Mr. Swanson at the above address. The DoR is also accepting written comments from persons that possess contribution claims regarding the matters addressed in the Voluntary Agreement for a period of thirty (30) days. These comments should be mailed to Cameron Swanson at the foregoing address.
